Terms & Conditions — Lull (Sleep Tracker AI Coach)

These terms are a binding agreement between you and Mileafy LLC, a Delaware limited liability company (est. 2022) with its registered office at 8 The Green, STE A, Dover, DE 19901, United States (“we”, “us”, “our”), covering your use of the Lull app for iPhone, iPad and Apple Watch, and any subscription you buy through it.
By downloading or using Lull, you accept these terms. If you do not accept them, do not use the app.

Lull is a wellness app, not a medical device, and not a doctor. Read Section 3 before you rely on anything it tells you.
1. The short version
- Lull tracks your sleep automatically from Apple Health, scores it, and coaches you on what to change. Some features are free; the rest require Lull Pro.
- Lull Pro is an auto-renewing subscription sold by Apple. It renews until you cancel it in your Apple Account settings. Deleting the app or your Lull account does not cancel it.
- If a free trial is offered, we will try to remind you 2 days before it ends so you can cancel without being charged. That reminder is a courtesy, not a guarantee — cancelling on time is your responsibility.
- Refunds are handled by Apple, not by us.
- Lull’s scores and AI coaching are informational. They are not medical advice and can be wrong.
- You keep ownership of your data. You can delete everything from inside the app.
2. Who may use Lull
You must be at least 16 years old, or the age of digital consent where you live if that is higher, to use Lull. If you are under the age of majority, you may only use it with a parent or guardian’s involvement, and they accept these terms on your behalf.
You must not use Lull where doing so would break local law, and you may not use it if you are barred from receiving software under applicable export or sanctions rules (see Section 15).
3. Health disclaimer — read this
Lull is a general wellness product. It is not a medical device, does not diagnose, treat, cure or prevent any condition, and has not been reviewed by any medical regulator.
Specifically:
- Scores and insights are estimates. Lull derives them from data Apple Health provides — largely from a watch or phone worn overnight. That data is itself approximate. Sleep stage estimates, heart rate and HRV readings can be inaccurate or missing entirely, and Lull’s 0–100 score is our own heuristic, not a clinical measurement.
- Correlations are not causes. Lull’s core function is spotting statistical associations between what you log and how you sleep. An association found over a handful of nights in one person’s data can easily be coincidence. Lull flags low-confidence findings, but you should treat all of them as hypotheses to test, not facts.
- The 4-week program is inspired by CBT-I, not a substitute for it. Cognitive behavioural therapy for insomnia is delivered by trained clinicians and adapted to the individual. Lull’s program is self-guided educational content built on the same principles. It is not therapy, and no clinician is supervising you.
- Techniques carry real-world risk. Breathing exercises, sleep restriction, the 20-minute rule, hot baths and app blocking affect your body and your routine. Do not use them if a clinician has advised otherwise. Stop if you feel unwell.
Do not use Lull to diagnose yourself or to make decisions about medication or treatment. Talk to a qualified clinician if you have or suspect a sleep disorder — including insomnia, sleep apnea, narcolepsy or restless legs — or if you have a heart, respiratory, psychiatric or neurological condition, are pregnant, or are experiencing severe or worsening sleep problems.
If you are in crisis or need urgent help, contact your local emergency services or a crisis line. Lull is not a crisis service and no one monitors what you write in it.
4. What Lull does, and what we promise about it
Lull reads sleep and related data from Apple Health with your permission, computes a score and trends on your device, lets you log lifestyle factors and run wind-down techniques, and offers AI-generated coaching grounded in those numbers. Optional Screen Time features can shield apps you choose during a wind-down window.
We provide the app as it is. We do not promise that:
- it will be available without interruption or error;
- automatic tracking will detect every night, or detect them correctly — Apple Health delivers data on its own schedule, and background delivery can be delayed or missed;
- notifications will always arrive, or arrive on time — iOS decides when to deliver them and can throttle or suppress them;
- any particular feature will keep existing. We may change, add or remove features. If we remove something material that you are paying for, Section 6.6 applies.
Device and system requirements. Lull requires a compatible Apple device running a supported version of iOS or iPadOS. Automatic sleep tracking requires sleep data in Apple Health, which in practice means an Apple Watch or another device that writes sleep to Health. Screen Time features require iOS Screen Time support and are unavailable on some devices and managed accounts. Health and Screen Time features do not work in the iOS Simulator. Keeping a compatible device and OS is your responsibility.
5. Your account
Lull creates an account for you so your setup survives a reinstall and so we can protect our AI features from abuse. You can use an anonymous account, or sign in with Apple or Google.
You are responsible for your account and for anything done through it. Keep control of the Apple or Google account you sign in with. Tell us at [email protected] if you think your account has been misused.
You may delete your account at any time in You → Delete account. This erases your data as described in our Privacy Policy. Note what it does not do: it does not cancel your subscription, and it does not refund anything. Cancel first if you also want billing to stop.
We may suspend or terminate your account if you breach these terms, if we must to comply with law, or if your usage threatens the service or other users. Where it is reasonable to do so, we will tell you why.
6. Lull Pro subscription
6.1 What it unlocks
Free features include automatic sleep tracking, your nightly score, the morning check-in and the individual wind-down techniques.
Lull Pro unlocks the parts that depend on sustained analysis: full trends and sleep analysis, factor logging and correlation, coach chat, the 4-week guided sleep program, and the Screen Time wind-down feature.
Feature allocation between free and Pro may change over time.
One thing to expect. Immediately after you finish onboarding, Lull shows the subscription offer without a “maybe later” option — you continue by starting a trial or subscribing, or by restoring an existing purchase. This happens once. If you close the app there and reopen it, you can use the free features described above, and the Pro features stay locked until you subscribe. Full pricing, term and trial details are shown on that screen before you commit to anything.
6.2 Price, term and billing
Lull Pro is offered as an auto-renewing subscription billed on a weekly term. The exact price, currency, term and any introductory or free-trial offer are shown on the purchase screen inside the app before you buy, in your local currency, and are the authoritative terms of your purchase. Prices vary by country and may change.
Your subscription is sold and billed by Apple, through your Apple Account. Payment is charged to that account on confirmation of purchase.
6.3 Automatic renewal — the part people miss
- Your subscription renews automatically at the end of each term, and your Apple Account is charged the then-current price, unless you cancel at least 24 hours before the current period ends.
- Cancel in Settings → Apple Account → Subscriptions on your device, or via the App Store. Uninstalling Lull does not cancel it. Deleting your Lull account does not cancel it. Only Apple can.
- Cancelling stops future renewals. You keep Pro until the end of the period you have already paid for.
6.4 Free trials
If a free trial is offered to you, it converts into a paid subscription automatically when it ends unless you cancel at least 24 hours before that.
We will attempt to notify you 2 days before a trial ends, by push notification, so you can cancel first. Treat this as a courtesy, not a guarantee: it depends on you granting notification permission, on your device being reachable, and on Apple’s push delivery. A missed reminder is not grounds for a refund and does not extend your trial. Check your trial end date in Settings → Apple Account → Subscriptions.
Apple limits free trials to one per subscription group per Apple Account (and per Family Sharing group). Whether you qualify is determined by Apple, not us.
6.5 Refunds and cancellation rights
We cannot issue refunds for App Store purchases — Apple controls billing. Request a refund from Apple at reportaproblem.apple.com, or through Settings → Apple Account → Subscriptions. Apple’s decision is governed by the Apple Media Services Terms and Conditions.
Consumers in the EU, EEA and UK have a statutory right to withdraw from a distance purchase within 14 days. Because Apple is the seller of record, exercise it through Apple using the links above. Be aware that this right can be lost once delivery of digital content begins with your consent — which for an app subscription is immediately on purchase.
Nothing here limits mandatory consumer rights you have under the law of your country of residence, including rights to a remedy where a digital service is faulty or not as described.
6.6 Changes to price or to Pro features
If we increase the price of your subscription, Apple will ask for your consent before the increased price is charged; where Apple’s rules permit an increase without explicit consent, you will be notified in advance and may cancel before it takes effect.
If we permanently remove a material Pro feature and do not provide a reasonable equivalent, you may cancel and, where consumer law entitles you to it, seek a proportionate refund from Apple for the unused remainder of your term.
6.7 Restoring purchases
Use Restore purchases on the paywall to re-activate Pro on a new device or after reinstalling, using the same Apple Account that bought it. Pro is tied to that Apple Account, not to your Lull account. If you signed in to Lull with a different provider on a new device, restore still works — but a Lull account you deleted is gone regardless.
7. Licence, and what you may not do
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of Lull on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and any applicable Family Sharing rules, for your own non-commercial use. That is the whole of what you get; we reserve all other rights.
You may not:
- copy, modify, translate, reverse-engineer, decompile or disassemble the app, or try to derive its source code, except to the extent applicable law expressly permits despite this restriction;
- rent, lease, lend, sell, sublicense, redistribute or publish the app;
- remove or obscure any proprietary notice;
- circumvent the paywall, entitlement checks, App Attest attestation, or any rate limit, or use a modified or jailbroken build to obtain Pro features;
- automate, script or scrape our backend, or call our Cloud Functions other than through the unmodified app;
- send load or requests designed to run up our model costs, probe for vulnerabilities, or otherwise interfere with the service or other users;
- use Lull to build a competing dataset or product, or to train a machine learning model;
- misuse the AI coach — including attempts to make it produce medical instructions, to extract our system prompts, or to use it for anything other than your own sleep.
We apply per-account rate limits and device attestation. Hitting a limit is not a fault. Sustained abuse is grounds for suspension under Section 5.
8. The AI coach — specific terms
Lull’s coaching features send a summary of numbers already computed on your device — plus text you type — to third-party AI providers (Anthropic and OpenAI) through our backend. See the Privacy Policy, Section 3.3, for exactly what is sent.
You should understand:
- Output can be wrong. Large language models produce fluent text that is sometimes inaccurate, incomplete or internally inconsistent, even when grounded in real numbers. Verify anything that matters. Never act on it in place of professional advice.
- Output is not reviewed by a human before you see it, and no clinician is involved.
- The coach is restricted to sleep. Off-topic messages are redirected. Do not rely on it for anything else.
- Do not put sensitive information in the chat or the habit log beyond what you need. Text you type is transmitted to a third-party provider to be processed.
- We do not own what you type, and we do not claim rights in AI output beyond what is needed to run the feature. Similar or identical output may be generated for other users.
- Availability is not guaranteed. These features depend on third-party APIs and can fail, degrade or be withdrawn. We use a fallback provider to reduce that risk, but a Pro subscription does not guarantee uninterrupted AI access.
9. Your content and your data
You keep all rights in the data you create in Lull — your logged factors, notes, check-ins and chat messages. We do not claim ownership.
You grant us only the licence needed to operate the app for you: to store, process and transmit that content to provide the features you use, including sending it to the processors named in the Privacy Policy. That licence ends when you delete the content or your account, except where we must retain something for a legal obligation (see Privacy Policy, Section 6).
Most of your data lives on your device. Backing it up is your responsibility — an iCloud or encrypted local backup covers it. If you delete the app, sign out, or wipe your device, on-device sleep history is gone and we cannot recover it, because we never had a copy.
10. Apple Health and Screen Time
Apple Health. Lull reads from Apple Health only with your permission and never writes to it. Revoking permission stops tracking; it does not delete what Lull has already computed on your device. Health data is never used for advertising or sold — see the Privacy Policy, Section 2.1.
Screen Time. If you enable wind-down blocking, you choose which apps to shield. Apple’s API gives us opaque tokens, so we cannot see which apps you picked. You are responsible for that choice: do not shield apps you may need in an emergency, for work, for safety, or for accessibility. Shielding is enforced by iOS, and we cannot guarantee it engages, lifts or behaves exactly as scheduled in every case. You can end it at any time in the app or in iOS Settings.
11. Intellectual property
Lull, the Lull and Mileafy LLC names and logos, the app’s design, code, scoring algorithms, program content, copy and analysis methods are owned by us or our licensors and protected by intellectual property law. These terms grant you no right to use our trademarks.
Third-party components are used under their own licences, which continue to apply to them.
12. Disclaimers
To the fullest extent the law allows, Lull is provided “as is” and “as available”, and we disclaim all warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that Lull will improve your sleep, that its scores or insights are accurate, or that following its suggestions will produce any particular result. Sleep is affected by many things Lull cannot see.
Some jurisdictions do not allow the exclusion of implied warranties or of certain consumer guarantees. Where that is the case, this section applies only to the extent permitted, and you keep every right you have that cannot be excluded. In particular, nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of Lull — even if we were told such damages were possible.
- We are not liable for health outcomes or decisions you make based on Lull’s scores, insights, coaching or program content. That is what Section 3 is for.
- We are not liable for failures of Apple Health, iOS notification delivery, Screen Time enforcement, Apple’s billing, or third-party AI providers, or for data loss caused by you deleting the app, signing out or wiping a device.
- Our total aggregate liability for all claims relating to Lull is limited to the greater of the amount you paid us for Lull in the 12 months before the claim arose, or USD 50.
These limits do not apply to liability that cannot be limited by law, and they do not affect your mandatory consumer rights.
14. Apple’s role — required terms
You and we agree that:
- These terms are between you and Mileafy LLC only, not with Apple. Apple is not a party to them.
- Apple has no obligation to furnish any maintenance or support for Lull. Support is ours to provide — email [email protected], or use Help & support in the app.
- If Lull fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Lull.
- Apple is not responsible for addressing any claim by you or a third party relating to Lull or your use of it, including product liability claims, claims that Lull fails to conform to any legal or regulatory requirement, and claims under consumer protection or privacy law.
- If a third party claims Lull infringes their intellectual property, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- You must comply with applicable third-party terms when using Lull — including the App Store Terms of Service and the Apple Media Services Terms and Conditions.
15. Export and legal compliance
You may not use or export Lull in violation of U.S. export laws or any other applicable export control or sanctions regime, and you confirm you are not subject to such restrictions.
16. Changes to these terms
We may update these terms — for example when features, pricing models or laws change. We will update the “Last updated” date and post the revised terms at this URL. If a change is material, we will give you reasonable notice in the app or by push before it takes effect.
Changes never apply retroactively to a subscription term you have already paid for. If you do not accept a change, stop using Lull and cancel your subscription before the next renewal. Continuing to use Lull after a change takes effect means you accept it.
17. Termination
You may stop using Lull at any time by deleting the app — and cancelling your subscription separately, per Section 6.3.
We may suspend or end your access as described in Section 5. On termination your licence under Section 7 ends immediately. Sections 3, 9, 11, 12, 13, 14 and 18 survive, as does any payment obligation already incurred. Termination by us does not automatically entitle you to a refund, though we will not act unreasonably, and your statutory rights are unaffected.
18. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules or to the U.N. Convention on Contracts for the International Sale of Goods. Subject to the consumer carve-out below, the state and federal courts located in the State of Delaware have non-exclusive jurisdiction over any dispute, and you and we consent to venue there.
If you are a consumer, this does not take away your local protections. Delaware law applies only to the extent it does not deprive you of the mandatory consumer law of your country or state of residence. You may bring proceedings in your local courts wherever the law gives you that right, and you are never required to litigate in Delaware if your local law says otherwise. EU consumers may also use the European Commission’s online dispute resolution platform.

19. General
- Entire agreement. These terms plus the Privacy Policy are the whole agreement between us about Lull, and supersede any earlier version.
- Severability. If a provision is unenforceable, the rest stays in force and the provision is applied as narrowly as needed to make it valid.
- No waiver. Not enforcing a right once does not waive it.
- Assignment. You may not assign these terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- No third-party rights, except Apple’s under Section 14.
- Language. The English version governs if a translation conflicts with it.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
